TERMS AND CONDITIONS

1. THE PROMOTION

1. The Gaymers® Cider Cow ‘a’oke promotion (the “Promotion”) is open to all UK and Republic of Ireland residents (including Channel Islands, Isle of Man and Northern Ireland residents) aged 18 and over, except the employees (and their immediate families) of Magners GB Limited, their subcontractors,  subsidiaries or anyone professionally connected with the Promotion.

2. Promoter: The Promotion is organised and run by Magners GB Limited, a company incorporated and registered in England and Wales with company number 07063165 and registered address The Communications Building, 48 Leicester Square, London, WC2H 7LT (“Magners GB”).

2. FACEBOOK

1. The Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to Magners GB and not to Facebook. The information entrants provide will only be used in accordance with the Magners GB privacy policy which can be found at: http://www.magners.com/privacy-policy.asp

2. Any questions, comments or complaints regarding the Promotion must be addressed to Magners GB at gaymersmusic@gmail.com and MUST NOT be directed to Facebook.

3. By participating in the Promotion entrants hereby release Facebook from all claims, liabilities, losses or damages incurred by them in connection with the Promotion.

3. PROMOTION ENTRY

1. The Promotion runs from 23rd – 27^th May 2011(inclusive).

2. No purchase is necessary. Promotion entry occurs by completing the entry process at http://www.facebook.com/gaymers (the “Website”), which includes the requirement to sign into Facebook via the Facebook Connect applet on the Website and “Like” the Gaymers® Music Facebook fan page via the Website.

3. Facebook users will visit the “Gaymers® cider” brand page

4. The user will then be presented with The Cow ‘a’ Oke game as a default tab.  If the visitor is not a fan of the page they will be asked to “Like” the page before being able to play the game.

5. Upon clicking “Like” the user will be asked to guess the artist and name of the song that Ella the Cow is mooing into the box provided (a new song will be mooed each day).  The user will be notified with the answer and winner later that day

6. If the user cannot guess the song, by inviting friends to ‘Like’ Gaymers clues will be revealed (there are five clues per day, 1 friend equals 1 clue)

7. Fans will only be able to enter once each day. 

8. The players will be told that they will be notified via Facebook if they are the lucky winner by 12noon the following day.

9. Each day there will be an announcement on Facebook who the lucky winner is for the previous day.

10. No bulk, third party or organised group entries will be accepted. Incomplete, illegible, or corrupt entries or those not in accordance with entry instructions will not be accepted. Magners GB takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

11. The closing date for receipt of entries is midnight on the day that you enter.

4. PRIZES

1. There are 5 Pairs of weekend standard tickets to give away. One pair of weekend tickets will be given away each day entitling the winner and a friend that is over 18 entry to Glastonbury festival

2. Accommodation and travelling costs of prize winner attendance at Glastonbury festival are not included as part of any prize. All prizes are as described, not transferable, not exchangeable for cash and no cash alternative will be offered in the event that any winner is unable to claim or use the prize for any reason.

3. If any advertised prize is not available, Magners GB reserves the right to offer an alternative prize of equal or greater value.

4. Prize winners must ensure that they and their guests comply with the relevant rules of entry when attending Glastonbury festival. Any refusal of entry is not the responsibility of Magners GB and Magners GB shall have no liability to the prize winner in respect of the same.

5. PRIZE DRAW

1. The prize winners will be chosen at random each day from all correct answers for that day by an independent judge. The prize winners will be notified by e-mail within 12 hours of the Promotion closing.

2. All winners must accept their prize within 24 hours of notification, by replying to the notification with a contact telephone number to arrange receipt of the prize. Failure to do so will be deemed as the winner forfeiting their prize, which will then go to the runner up.

6. GENERAL

1. The name of the prize winners will be made available on www.facebook.com/gaymers between Tuesday 24th May - Saturday 28^th May 2011

2. By entering the Promotion all prize winners agree to participate in publicity and material resulting from the Promotion if requested to do so by Magners GB and Magners GB reserves the right to use such material and details of the all prize winners in any publicity and/or promotional material connected with the Promotion.

3. For the avoidance of doubt any participants’ personal data relating to the Promotion will be used solely in accordance with current UK data protection legislation and for the administration of the Promotion. It will not be disclosed to a third party without the individual’s prior consent to do so. Please read Magners GB’s privacy policy, available on http://www.magners.com/privacy-policy.asp which gives full details of how Magners GB uses any personal information it may collect about participants.

4. By entering this Promotion, participants acknowledge that they have read, understood and accept and agree to be bound by these terms and conditions and by the decision of Magners GB in relation to all matters relating to the promotion. Magners GB decision shall be final. No correspondence shall be entered into.

5. Magners GB accepts no responsibility for any damage, loss, injury or disappointment suffered by any participant entering the Promotion or as a result of accepting the prize. Magners GB is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the internet, telephone lines or at any website, or any combination thereof, including any injury or damage to the participant's or any other person's computer or mobile telephone related to or resulting from participation in the Promotion. Magners GB will not be liable for any loss or damage whatsoever caused by matters relating to the Promotion. Nothing shall exclude Magners GB’ liability for death or personal injury as a result of its negligence or for fraud or fraudulent misrepresentation.

6. Events may occur that render the promotion itself or the awarding or the delivery of any prize impossible due to reasons beyond the control of Magners GB and accordingly Magners GB may at its absolute discretion vary or amend the Promotion and the participant agrees that no liability shall attach to Magners GB as a result thereof. Any such variation or amendment will be notified on the Website.

7. The Promotion and these terms and conditions are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the Courts of England and Wales.
